Filing for legal separation is an attractive option for couples who wish to lead separate lives physically and financially while retaining their married status for religious, insurance, or other reasons. A legal separation is prepared in the same manner as a petition for marriage dissolution (divorce) and addresses all the typical divorce issues, including:
- Child custody
- Child support
- Visitation
- Spousal support (alimony)
- Evaluation and division of property
The only difference is that, rather than file a petition for dissolution, we will file for legal separation.
In California, there is no waiting period or residency requirement to file for legal separation. However, to file for divorce, you must be a resident of California for six months and a resident of your county for three months. Couples who do not meet the residency or jurisdictional requirements for divorce can file for legal separation and then have the petition modified into a divorce action.
